Throughout these Terms of Service, the terms “we”, “us” and “our” refer to LiquidPro Ltd.

These Terms of Service govern the use of our online store and the purchase of products through our website.

By placing an order, you agree to these Terms of Service.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable law.

2. Products

We sell Ear Pro ear care products, including products designed to help prevent water-related ear problems and other ear care solutions.

Product descriptions, instructions for use, ingredients, warnings and other relevant information are provided on the respective product pages and, where applicable, on product packaging.

Customers should read and follow the instructions for use before using any product.

We make reasonable efforts to ensure that product information, images and descriptions are accurate and up to date.

Minor differences in packaging or product appearance may occur.

We reserve the right to modify or discontinue products, subject to applicable consumer protection laws and existing contractual obligations.

3. Orders and Contract Formation

Products displayed on our website constitute an invitation to place an order.

By completing the checkout process and submitting an order, you make an offer to purchase the selected products.

After placing an order, you will receive an automated order confirmation by email.

A purchase contract is concluded when we accept your order, for example by sending a separate acceptance or dispatch confirmation.

We reserve the right to reject an order for legitimate reasons, including product unavailability, suspected fraud or obvious pricing errors.

If an order cannot be fulfilled and payment has already been collected, the corresponding amount will be refunded without undue delay.

Before submitting an order, customers have the opportunity to review and correct their order details.

4. Prices and Payment

All prices are displayed in the currency indicated during the shopping process.

For deliveries within the European Union, prices displayed to consumers include applicable VAT, unless otherwise clearly indicated in accordance with applicable law.

Any applicable shipping charges are displayed before the customer submits the order.

For deliveries to Switzerland, LiquidPro Ltd. covers applicable customs duties, import taxes and customs clearance fees. Customers will not be required to pay additional import-related charges upon delivery.

Payment can be made using the payment methods available at checkout.

Payment processing is carried out through secure third-party payment service providers.

We do not store complete payment card details on our own servers.

5. Shipping and Delivery

We deliver to the 27 Member States of the European Union and Switzerland.

Available delivery methods, shipping costs and estimated delivery times are displayed during checkout or in our Shipping Policy.

Orders are generally processed within the timeframe indicated on our website.

Delivery times are estimates unless a binding delivery date has been expressly agreed.

If delivery is delayed, customers retain all rights available under applicable consumer protection laws.

For consumer purchases, the risk of loss or damage generally passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

This does not affect any different mandatory rules applicable to particular transactions.

For further details, please refer to our Shipping Policy.

6. Right of Withdrawal

6.1 EU Customers

Consumers residing in the European Union generally have the right to withdraw from a distance sales contract within 14 days, without giving any reason.

The withdrawal period expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.

Where a single order contains multiple goods delivered separately, the withdrawal period begins when the last item is received.

To exercise the right of withdrawal, customers must inform us of their decision through a clear statement before the withdrawal period expires.

Customers may contact us at:

info@earpro.co

The detailed withdrawal procedure, statutory exceptions and model withdrawal form are provided in our Refund and Withdrawal Policy.

6.2 Customers in Switzerland

We voluntarily provide customers in Switzerland with a contractual right to withdraw from their purchase within 14 days of receiving the goods, subject to the conditions and exceptions described in our Refund and Withdrawal Policy.

6.3 Return Shipping Costs

Customers are responsible for the direct cost of returning goods when exercising their right of withdrawal, unless otherwise agreed or required by applicable law.

This does not affect customers' rights in cases involving defective, damaged or non-conforming products.

7. Refunds

When a customer validly exercises the statutory right of withdrawal, we will reimburse payments received for the returned goods, including applicable standard outbound delivery costs, as required by law.

For EU consumers, reimbursement will be made without undue delay and no later than 14 days after we have been informed of the decision to withdraw.

We may withhold reimbursement until we have received the goods or the customer has provided evidence of having sent them back, whichever occurs first.

Refunds will generally be made using the same payment method used for the original transaction, unless otherwise expressly agreed.

Customers will not incur fees as a result of such reimbursement.

For further information, please refer to our Refund and Withdrawal Policy.

8. Defective or Non-Conforming Products

We are committed to supplying products that conform to the purchase contract and applicable legal requirements.

If a product is defective, damaged or does not conform to the contract, customers may be entitled to remedies under applicable law.

Depending on the circumstances and applicable legislation, these remedies may include replacement, repair, a price reduction or termination of the contract with a refund.

Nothing in these Terms excludes or restricts mandatory statutory rights relating to defective or non-conforming goods.

If you experience a problem with a product, please contact us at info@earpro.co, providing your order number and a description of the issue.

Where possible, photographs may help us assess the problem.

9. Product Use and Safety

Our products must be used in accordance with their instructions for use, warnings and intended purpose.

Customers should not use products in a manner contrary to the manufacturer's instructions.

Product information provided on our website is not intended to replace professional medical advice, diagnosis or treatment.

If you experience persistent or severe ear symptoms, you should seek advice from a qualified healthcare professional.

Nothing in this section limits our liability under applicable product safety or product liability legislation.

10. Intellectual Property

All content on this website, including text, graphics, photographs, product descriptions, logos, trademarks and design elements, is owned by or licensed to LiquidPro Ltd. or its respective rights holders.

Such content is protected by applicable intellectual property laws.

No content may be reproduced, distributed or used for commercial purposes without prior written permission, except where permitted by law.

11. Website Availability and Accuracy

We make reasonable efforts to keep our website accessible and its content accurate.

However, temporary interruptions, technical errors or inaccuracies may occur.

We reserve the right to correct obvious errors and update website content.

Any correction affecting an existing purchase contract will be handled in accordance with applicable law.

We are not responsible for interruptions caused by circumstances beyond our reasonable control, except where liability cannot lawfully be excluded.

12. Third-Party Services

Our online store is powered by Shopify.

Certain services, including payment processing and shipping, may be provided by third-party service providers.

Purchases made through this website are contracts between the customer and LiquidPro Ltd., not Shopify.

The use of third-party services does not affect LiquidPro Ltd.'s obligations to customers under applicable consumer protection laws.

13. Privacy and Personal Data

We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), where applicable.

Information about the collection, use, storage and protection of personal data is provided in our Privacy Policy.

Customers can review our Privacy Policy on our website.

14. Liability

LiquidPro Ltd. is liable in accordance with applicable law.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence, where such liability cannot lawfully be excluded.
  • Fraud or fraudulent misrepresentation.
  • Mandatory product liability obligations.
  • Breaches of statutory consumer rights.
  • Any other liability that cannot legally be excluded or restricted.

To the extent permitted by applicable law, we are not responsible for losses arising from improper use of products contrary to their instructions or from circumstances beyond our reasonable control.

15. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Malta.

However, where customers qualify as consumers residing in another country, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law applicable to their consumer contract.

Consumers may bring legal proceedings before the courts competent under applicable law, including relevant consumer jurisdiction rules.

We encourage customers to contact us directly at info@earpro.co so that we can attempt to resolve any concerns amicably.

Nothing in this section restricts consumers' rights to seek legal remedies before competent courts or authorities.

16. Changes to These Terms

We may update these Terms of Service to reflect changes in our business operations, legal requirements or services.

The current version will be published on our website.

Changes will not retroactively alter the terms of an existing purchase contract without the customer's agreement, except where permitted by applicable law.
